Defendant John Michael Beames was charged with one count of first degree murder (Pen. Code, 187, subd. (a)), one count of torture (206), and one count of possession of a firearm by a felon (12021, subd. (a)). He entered a plea of guilty on the firearm possession count. He also admitted allegations in the murder and the torture counts that he had been previously convicted of at least two felonies in California (1203, subd. (e)(4)) and previously convicted of a serious felony offense (667, subd. (a)). Thereafter, a jury found defendant guilty on the first degree murder count, and found true the special circumstance allegation that the murder was intentional and involved the infliction of torture (190.2, subd. (a)(18)). The jury also found defendant guilty on the torture count, and found true the allegation in this count that he personally inflicted great bodily injury. (12022.7.) At the penalty phase of trial, the jury returned a verdict of death. Appeal to this court is automatic. (1239, subd. (b).)
